Requiring a Subscribing Witnesses to Lease Real Property is a Thing of the Past

On Saturday, June 27, Governor DeSantis signed HB 0469 into law to remove the requirement for subscribing witnesses to a lease of real property. Landlords can now use their discretion if they will require a witness signature. Prior to signing this into law, all leases, regardless of the space size and term, were required to have a subscribing witness to be enforceable. This requirement would hold up the process for both the landlord and tenant. Commercial Real Estate will be in a better position by having the ability to expedite the contractual process.
